To conduct such activities functional to the sale of products via the Vespa Online Store, Triboo Digitale processes user data such as name and surname, residence and information on credit cards used by users (such as first and last name of the card holder, card number, expiration date, security code), as Data Controller, in accordance with applicable privacy code.
With your express consent that you can grant to Vespa Online Store and Triboo Digitale in the Vespa Online Store Privacy Policy section, the data collected and processed by Triboo Digitale to manage sales via the Vespa Online Store shall be communicated to Vespa Online Store and Triboo Digitale for individual processing in accordance with the Store.vespa.com Information Note.

These provisions concerning user privacy (the “Privacy Policy”) are applicable to the store.vespa.com website (the “Site”) and relate to the processing of personal data by Piaggio & C. S.p.A and Triboo Digitale while users are browsing the Site further to interaction by users with the services and features provided via the Site. The Privacy Policy represents the information to Data Subjects pursuant to Art. 13 of Legislative Decree No. 196 June 30, 2003 (the “Privacy Code”) and contemplates Recommendation no. 2/2001 of May 17, 2001 of the Working Party on the Protection of Personal Data in relation to the minimum requirements for the collection of data on-line in the European Union. Controller And Persons Responsible For The Processing Of Data
The Data Controllers are Piaggio & C. S.p.A. and Triboo Digitale (“the Data Controllers”), hence any communications may be sent to both Piaggio & C. S.p.A. via Rinaldo Piaggio 25 – 56025 Pontedera (PI); and to Triboo Digitale S.r.l. Viale Sarca, 336 – 20126, Milan, Fax +39.02 64741414; e-mail info@triboo.it. The persons responsible for the process involving the exercising of the rights granted to Data Subjects under art. 7 of the Privacy Code are currently Piaggio & C. S.p.A. and Triboo Digitale (“theChief Processors”), domiciled for the purpose at their registered offices.
Nature and type of data collected and processed. Scope and purpose of the processing
The processing of personal data of users who simply browse and consult the Site refers to standard navigation data, data whose transmission to the Site is implicit in the computerised systems used to manage the Site and the use of individual internet communication protocols. Navigation data include, without limitation, IP addresses or domain names of computers used by users to log on to the Site further to other parameters related to the type of software and computer operating systems used by users. Navigation data is not collected by the Data Controllers to be associated with users or identified parties, nevertheless, due to their nature, they could permit the identification of the user if processed and associated with data held by third parties. Navigation data is collected and processed by the Data Controllers for the sole purpose of drawing up statistics, and in a totally anonymous manner in relation to the access and use of the Site, and in order to monitor and improve the functions and contents of the Site itself. Data processing features and methods
Personal data collected by the Data Controllers are mainly processed using automated, computer and electronic instruments with data logics and procedures strictly related to the aforementioned scope and purposes. Data Controllers shall communicate user personal data to the extent and in the manner illustrated in this Privacy Policy, and in the Information Note published at the moment users grant consent to the use of their data and, in any case, in full compliance with the consent granted by users during the data collection process, when required by the Privacy Code.
The data will be accessible to our in-house and external staff designated to such processing activities in relation to the aforementioned scope and purposes and to the Chief Processer. The full list of the Designated Officers and the subjects to whom the data can be provided by request to the Data Controllers or Chief Processers.
Personal user data may be communicated to professionals, independent consultants, including associations, companies that provide technical and organisational services used by the Data Controllers in order to fulfil the aforementioned processing requirements, to third parties in case of mergers, acquisitions, disposal of companies or business branches and other extraordinary transactions, and any further recipients of communications provided for by applicable laws or regulations in force. Conferral of personal data
Except for what illustrated above in relation to the so-called navigation data, the transfer of data by the user is required to provide services and features requested by the user, such as registration on the Site and other features provided by the Site and its management, answers to user queries and sending of information and material requested by the user. This Privacy Policy may be updated by the Data Controllers from time to time. The version published on the Site is the one currently in force. In case of amendments to this Privacy Policy, the Data Controllers will warn users of such changes, posting a link to the new privacy policy containing the words “Recently Modified Privacy Policy” on the Site for thirty (30) days from the amendment. In addition Personal data may be disclosed to police forces or judicial authorities, in accordance with the law in force and after receiving formal request by such entities, for example for anti-fraud investigations conducted by store.vespa.co.za.
Personal Data will also be accessible to Chief Data Processors as indicated in paragraph 2 and for the specific purposes listed therein. Your consent is not required for any of the above cases. Personal data will not be transferred abroad to Countries other than those belonging to the European Union, which do not guarantee a sufficient level of privacy protection. In all such cases, users are required to be sure to obtain the consent of the person in question before conferring their data to Triboo Digitale, and to inform about this Privacy Policy: you will, in fact, be the only person responsible for the conferral of third party information and data without specific request or consent of the same, further to any misuse or illegal use of the same. 3. What happens if you do not disclose your Personal Data to Triboo Digitale
Disclosure of Personal Data to Triboo Digitale and, in particular, personal data, your email address, your mailing address, your credit card / debit card and bank details and phone number, is required in order to fulfil our Commercial Purposes.
Refusal to disclose certain Personal Data necessary for such purposes to Triboo Digitale, may make it impossible for the same to complete all store.vespa.co.za purchase contract phases, and/or fulfil all obligations required by the laws and regulations in force. 4. To whom we disclose your Personal Data
